1. Scope
These general terms and conditions of sale (T&Cs) govern all orders for goods placed with Thurion GmbH, Gartenstrasse 7, 4107 Ettingen, through the Coffee Service online shop, available at coffee-service.ch and erp.thurion.ch, by post, by telephone or by email.
They apply to the exclusion of any conflicting terms of the customer. Special agreements bind Thurion GmbH only if confirmed in writing.
The provision of coffee machines, service and maintenance contracts and supply agreements with business customers are the subject of separate contracts; these T&Cs apply to them on a supplementary basis only.

3. Conclusion of the contract
The presentation of products in the online shop does not constitute an offer in the legal sense, but an invitation to order.
Ordering takes place in four steps: selecting items and placing them in the cart, entering the billing and delivery addresses, choosing the delivery and payment method, and confirming the order on a summary page. Until confirmation, the customer may go back at any time, change the cart and correct the data entered. Acceptance of these T&Cs is requested before confirmation.
Confirming the order constitutes an offer by the customer. Thurion GmbH acknowledges receipt without delay by email; this acknowledgement does not yet constitute acceptance. The contract is concluded when the order confirmation is sent by email or by post, or when the goods are delivered.
Acceptance is subject to the availability of the goods. If an ordered item is not available, the customer is informed and any payment already made is refunded without delay.
The text of the contract is not stored in a form accessible to the customer; we recommend keeping the order confirmation.
4. Capacity and age
Orders are reserved for persons with legal capacity. Payment on invoice is further reserved for customers of full age and for business customers.
5. Prices
Prices are stated in Swiss francs, including value added tax. Shipping costs are shown separately in accordance with section 6 and summarised before the order is confirmed.
The prices displayed at the time of ordering apply. Thurion GmbH may change its prices at any time; changes have no effect on orders already confirmed.
In the event of an obvious error in a stated price, Thurion GmbH informs the customer without delay. Mere calculation errors do not render the contract any less binding but must be corrected (art. 24 para. 3 CO); where the error is fundamental within the meaning of art. 23 et seq. CO, Thurion GmbH may declare the contract non-binding. In both cases the customer may withdraw the order, and any payment already made is refunded in full without delay.
6. Delivery and shipping costs
The delivery area comprises Switzerland and the Principality of Liechtenstein. No deliveries are made abroad.
Goods are shipped by Swiss Post Ltd as Priority mail, with "pro clima" climate compensation paid by Thurion GmbH.
Shipping costs: delivery is free for orders of CHF 100.– or more. Below this amount, a flat rate of CHF 9.– is charged, including shipping and packaging.
Orders are normally handed over to Swiss Post within one to two working days. Delivery times are guidelines and not fixed dates. Thurion GmbH is not liable for delays caused by the carrier or for events of force majeure; the customer may not derive any claim for damages or right of withdrawal from them, except in the case of a delay that makes performance obviously worthless to the customer.
If the goods ordered are not in stock, the customer is notified through the channel used for the order.
Transfer of risk. For business customers, benefit and risk pass to the customer when the goods are handed over to the carrier. For private customers, they pass when the goods are received by the customer or by the person designated by the customer.
7. Payment methods
Online shop. Payment is made by advance bank transfer: the payment details are communicated with the order confirmation, and the goods are dispatched once the amount has been received. Additional payment methods are displayed in the shop at the time of ordering once they are activated; only the methods actually offered during the order are available.
Business customers. Payment on invoice may be agreed with business customers and public institutions. The amount is then payable net within 30 days of the invoice date. Thurion GmbH may restrict the payment methods offered for a particular order without giving reasons, in particular for a first order.
Credit check. Where payment on invoice is requested, Thurion GmbH may have the customer's creditworthiness checked by a Swiss credit reference agency. The name or company name, address and order amount are transmitted for this purpose. The result is used exclusively to decide whether payment on invoice is granted; it does not lead to any automated decision and is assessed by a person. A refusal of payment on invoice does not prevent the order from being placed with another payment method. The processing is described in section 4.6 of the privacy policy.
Late payment. As the payment period is fixed, the customer is in default on expiry of the due date without any reminder (art. 102 para. 2 CO). Default interest of 5% per annum is owed from the day following the due date (art. 104 para. 1 CO). The first reminder is free of charge; from the second reminder onwards, a flat fee of CHF 20.– including VAT is owed per reminder. After a final unsuccessful reminder, the claim may be passed to a collection partner or enforced through debt collection proceedings, at the debtor's expense to the extent permitted by law.
8. Retention of title
The goods delivered remain the property of Thurion GmbH until the price has been paid in full. Thurion GmbH is entitled to have the retention of title entered in the register kept by the debt enforcement office at the customer's place of residence (art. 715 CC); the customer undertakes to cooperate with this entry and not to sell or encumber the goods before full payment.
9. 14-day right of return
Thurion GmbH voluntarily grants a right of return of 14 days from receipt of the goods, subject to the following conditions:
- the goods are returned in new condition, unused and in their original packaging;
- the date on which the return is posted determines whether the deadline has been met;
- pods, capsules and coffee beans, and all other foodstuffs, are excluded from the right of return for hygiene reasons.
On request to info@coffee-service.ch or on +41 61 722 10 40, the customer receives a free return label. Return costs incurred without this label are not reimbursed. Return address: Thurion GmbH, Gartenstrasse 7, 4107 Ettingen. The price paid is refunded within ten days of receipt of the returned goods, using the payment method used for the order.
This right is contractual, not statutory: orders placed in the online shop are not subject to the right of revocation under art. 40a et seq. CO, which covers doorstep and telephone sales.
Orders placed by telephone. Where a private customer orders goods by telephone for personal or family use for an amount exceeding CHF 100.–, the customer has the statutory right of revocation under art. 40a et seq. CO. This right may be exercised without any particular form within fourteen days from the time the customer placed the order and received written information about this right. This information is provided with the order confirmation, together with the address stated in section 2. The contractual right of return under this section applies in addition to the statutory right of revocation and does not restrict it.
10. Warranty for defects
The customer inspects the goods on receipt and notifies Thurion GmbH of any defects found without delay; defects not detectable during this inspection must be notified immediately after their discovery (art. 201 CO). Where there is no risk of the defect worsening, notice given within seven days of its discovery is as a rule considered timely. Notices are to be sent to info@coffee-service.ch or given on +41 61 722 10 40.
In the case of a proven defect, Thurion GmbH repairs or replaces the goods, at its discretion. If repair or replacement fails, the customer may demand a price reduction or rescission of the contract.
Duration. The limitation period for private customers is two years from delivery. For business customers, it is twelve months for new appliances. More extensive warranties under the sales contract or from the manufacturer for coffee machines are reserved and prevail where they are more favourable to the customer.
11. Liability
Thurion GmbH is liable for damage caused intentionally or through gross negligence; this liability cannot be excluded in advance (art. 100 para. 1 CO).
Otherwise, contractual and non-contractual liability is excluded to the extent permitted by law, in particular for indirect damage and loss of profit. Towards private customers, this exclusion does not extend to personal injury, to damage caused directly to other property of the customer, or to claims under the warranty for defects pursuant to section 10.
Liability under the Federal Product Liability Act and any liability that the law declares mandatory remain reserved.
12. Website and customer account
The website and the Coffee Service online shop are accessible subject to their technical availability. Interruptions due to technical faults or maintenance work may occur; they do not give rise to any claims by the customer.
The customer keeps their access data safe and prevents its use by third parties. The customer informs Thurion GmbH without delay of any misuse detected.
13. Intellectual property
The content of the website — texts, images, layout — is protected by copyright. Any use, reproduction or disclosure for public or commercial purposes requires the written consent of Thurion GmbH. Trademarks, company names and logos on the website remain the property of their respective owners.
14. Data protection
Personal data is processed in accordance with the Federal Act on Data Protection and with the privacy policy published on this website, which forms an integral part of these T&Cs.
15. Amendments and partial invalidity
Thurion GmbH may amend these T&Cs at any time. The version in force at the time the contract is concluded applies to an order.
If any provision of these T&Cs is or becomes invalid or unenforceable, the validity of the remaining provisions is not affected. The invalid provision is replaced by the applicable statutory rule or, failing that, by the valid provision that comes closest to the economic purpose pursued.
16. Applicable law and place of jurisdiction
These T&Cs and all contracts arising from them are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For disputes with business customers, the exclusive place of jurisdiction is Liestal.
For disputes with consumers, the mandatory statutory places of jurisdiction under art. 32 and 35 CPC are reserved: consumers may bring an action at their place of residence or at the registered office of Thurion GmbH, and cannot waive this right before the dispute arises.
17. Clauses requiring particular attention
The following clauses depart from the default statutory regime or specify how it applies; the customer is invited to take note of them before accepting these T&Cs: section 6 (transfer of risk for business customers), section 8 (retention of title and duty to cooperate with its registration), section 9 (exclusion of foodstuffs from the right of return), section 10 (twelve-month warranty period for business customers), section 11 (exclusion of liability) and section 16 (place of jurisdiction in Liestal for business customers).
18. Authoritative version
These T&Cs are published in French, German and English. The French version prevails; the German and English versions are provided for information. In the event of any discrepancy between the versions, the French version takes precedence.
